DUI/DWAI

DUI/DWAI Lawyer in Greeley, Colorado

Experienced Representation in DUI/DWAI Cases

When you have been charged with drunk driving or driving while your abilities are impaired (DWAI), the potential consequences can severely limit your lifestyle and your ability to get to and from work. Your license may be suspended or revoked for a significant period of time. You may face substantial fines and even jail time. You want an experienced attorney, one who understands the law, who knows how DUI/DWAI cases are prosecuted and who will ensure that your rights are protected.

At the McAdams Law Office LLC, in Greeley, we represent clients throughout Weld County, Larimer County and Morgan County who have been charged with a DUI or DWAI. With experience in the Weld County district attorney's office, we know how criminal cases are prepared and can identify weaknesses in the prosecutor's case. Contact our offices to set up a free initial consultation.

The Difference Between DUI and DWAI

The distinction between a DUI and a DWAI is based on your blood alcohol concentration (BAC) at the time of your arrest. If your BAC is between .05 and .079, you will be charged with driving while abilities impaired (DWAI). If you test at .08 or higher, you will be charged with DUI. While a DWAI is the less serious of the two charges, it will still result in 8 points on your drivers license and can result in fines. A DUI will add 12 points to your driving record, carries higher fines and can result in jail time.

At the McAdams Law Office LLC, we will handle the criminal proceeding as well as the DMV hearing regarding license suspension or revocation. If you test at .08 or higher and are charged with a DUI, your license will be suspended immediately. You then have 7 days to request an Express Consent Hearing, where the court will determine whether the arrest was proper. We will ensure that the proper procedures were followed, that there was probable cause to pull you over, that you were properly advised of your rights before the police took any statements, and that the field sobriety and breath tests were correctly administered.

If the charge is your first DUI or DWAI offense, we will ask the administrative judge to issue you a "red" license, so that you can drive to work or to the doctor's office.
